What is the purpose of the Failure to Appear (FTAP) Program?

It was started in 1995 because the number of people failing to appear in court for traffic violations was alarming. Enforcing traffic laws is essential for public health and safety. The Failure to Appear (FTAP) Program is designed to encourage individuals who have not appeared in court or fulfilled a judgment to resolve their cases, or face restrictions on renewing their driver’s license in the future. Driver’s licenses are not suspended under this program—this is simply a hold on future license renewal to encourage court compliance.

I have one or more outstanding violations. What does that mean, and what do I need to do?

An outstanding violation is an unresolved citation or judgment reported to the FTAP by a court. You won’t be allowed to renew your driver’s license until the court is satisfied and the FTAP hold is lifted. If this violation has been resolved or reported in error, contact the court that issued the citation. Only the issuing court can clear the violation and remove the renewal hold.

A court added me to the FTAP, but I still have time before renewing my driver’s license. Can I still drive legally with my current license?

If your driver’s license is valid, you can legally drive until its renewal date, even with an FTAP renewal hold. For example, if you’re added to the FTAP and your license has four years until renewal, you can drive legally for those four years, giving you time to resolve your case with the court.

What if I have a renewal hold, my driver’s license has expired, and I need to drive to work to pay off the amount owed? Can I get an Occupational Driver’s License (ODL)?

If you cannot renew your license due to an FTAP hold, you may be eligible for an Occupational Driver’s License allowing you to drive for specific purposes temporarily while working to satisfy the court. Contact the court to determine if you can obtain an ODL.

My driver’s license has expired. Can I get an identification card?

You may be eligible for a Texas Identification Card. The Department of Public Safety issues Texas ID cards, and you can use the following link for more information: https://www.dps.texas.gov/section/driver-license/how-apply-texas-identification-card.

What if I’m indigent?

Under Section 706.006(d) of the Transportation Code, a court cannot require an indigent person to pay the $10 FTAP reimbursement fee. If you cannot pay the amounts owed to the court, it will assess your ability to pay and consider alternatives to monetary payment.

What if I can’t pay the full amount I owe right now? Can I get a payment plan or do community service?

Courts have wide discretion to authorize a payment plan or community service and can prescribe terms accordingly. Courts may assess your ability to pay and even waive amounts owed in some cases; however, you must contact the court to begin satisfying the amounts owed.

Do I have to pay the full amount owed before a court will lift the FTAP hold on my license renewal?

Courts have discretion to require full, partial, or no payment before lifting a renewal hold. Contact the court to arrange a satisfactory agreement, which could include a payment plan or community service. You must still pay the mandatory $10 FTAP reimbursement fee unless you’re indigent or it’s otherwise waived.

Can I send payment for violations to the Department of Public Safety or OmniBase Services?

No. Payments must be made to the reporting court once the amount owed is verified.

Can I pay my fine with a credit card or personal check?

Contact the reporting court to determine acceptable payment options.

Can I make one payment to cover violations reported by multiple courts?

No. You must contact and pay—or otherwise satisfy—each court separately.

Can I contact the court and/or pay online?

Some courts offer online payment options. Contact the court directly or visit its website for information on online payment options.

Can I submit documentation to the Department of Public Safety proving a violation has been paid to renew my license?

No. Once the reporting court is satisfied, it must notify OmniBase Services to remove your case from the FTAP and lift the renewal hold.

I’ve been incarcerated and can’t pay the amounts I owe. Can I get credit for time served applied to amounts owed to the court?

Courts may credit amounts owed for time served during incarceration. Contact the court to determine how credit for time served can apply to your case.

Where can I get information about outstanding warrants?

The FTAP does not have information about warrants. You’ll need to contact the court to determine if a warrant has been issued.

A warrant has been issued for me, but I want to resolve my case with the court. Will I be arrested if I appear at the court to resolve it?

The court will withdraw (terminate) a warrant for failure to appear if you voluntarily appear and make a good faith effort to resolve it before the warrant is executed (Code Crim. Proc., Art. 45A.104(g)).

I didn’t receive notice that my license renewal was denied.

Citations include language notifying you that non-renewal of your driver’s license is a potential penalty for failing to appear or pay. When the court adds your case to the FTAP, OmniBase Services mails notification letters to the address provided at the time of the violation. Additionally, the Department of Public Safety mails a courtesy notification before your renewal date to the address on file; however, these are courtesy notices and do not affect the legality of the renewal denial.

I received a letter but wasn’t listed in the database.

If the database shows no violations on your record, the violation has been resolved, or the data you entered doesn’t exactly match the database information. If you entered your driver’s license number and date of birth correctly, call 1-800-686-0570 and speak with a representative for assistance.

What should I do if I have trouble contacting the court—nobody answers, or I get a busy signal?

Can I be denied license renewal for non-traffic violations?

Yes. Justice and municipal courts can use the FTAP to encourage court compliance for both traffic and non-traffic violations.

Does the FTAP database have a record of all outstanding violations I might have in Texas?

No. The FTAP database only contains outstanding violations reported by jurisdictions participating in the Failure to Appear Program with a contract with the Department of Public Safety.

What is the statutory authority for the FTAP?

The FTAP is governed by and codified in Texas Transportation Code Chapter 706.

I have an FTAP renewal hold on my driver’s license. Does this prohibit my ability to vote?
